If during the K1 interview it transpires that your fiancee is pregnant, normally the consular officer will arrange for a seperate visa for the baby before she departs for America. You as the American citizen would however have to given a written acknowledgment that you would still be willing to marry her. K1 Visa Nightmare, International Marriage Broker Regulation Act

Man I going through hell with the K1 visa in the United States, apply for my Thai fiancee way back during April everything went very fast and I got approval then she got the package 3, and we did everything then did package 4 which came with her interview date. About 1 week after she received her interview date she had received a telephone call from the US Embassy in Bangkok to say that the interview has been canceled.
The application from what I understand was sent back to the United States as they forgotten to apply the new law call “International Marriage Broker Regulation Act” to my original application. Since then, and we are talking about May there has been no news. I call but nobody gives me any new information on my case.
I was very happy when we received the date she would of been here already, the interview was for early June, now I just wait.

I would assume that you are American and marrying a Thai? It seems to be the case that getting the fiance visa to the states is easier. There are a number of outlets near the US Embassy that can take care of all of the paperwork for you. Registering with the Thai government is easy enough to do on your own with any Amphur. You will also need to register this with the embassy …. all kinds of crap to do. It is easier to go ahead and hire someone to reduce the legwork if you have the money for it.

We’ll apply for a K-3. I’ve talked to her daily for at least an hour and spent weeks at at time together, different times. She’s a better person that some assumption-encumbered, cynical members here could ever dream of becoming. If you spot it, you got it ticotim.

K-3 visa for spouse is about the same processing times as a K-1 fiance visa now. Just a lot more fee$ to pay. But it has the advantage os the I-130 which would allow the beneficiary to work in America upon entering. Immigrant visa. You can drop the slow one, whichever, or pay $200 if you want to continue the I-130 as well if the I-129F is OK’d first.

Best of luck! The wait is a pain in the ass. Took us 6 months from when we registered (K1) until everything was completed and we were able to leave. The embassy was pretty good to deal with, just could not give us specific dates…so just had to hang out and wait…and eat great Thai food…and play pool…and watch movies…and have a BLAST! You’ll fill out Customs declarations, Form 6059B and present your passports — and she her K1-Visa paperwork. You will go through the U.S. Citizens line and she the Foreign Visitors line.
She does not meet the threshold of a dependent until she is your “spouse.” The Definition of Dependent requires an individual to be either a “qualifying child” or a “qualifying relative.”

The important thing to remember is that while going through the AOS process is also a real pain in the ass, with even more and worse forms to fill out and even more waiting, once she’s here she’s mostly okay. Even if the process takes a few years to work out, she can live here and work and all that during almost all of that time, though some forms you’ll have to re-file every year.
The dependent thing doesn’t affect you. You gots to marry her within 90* days of her entry with the K1, so you’ll be married by the end of the year, and if you’re married on 12/31/07, you were married for the whole year as far as the IRS cares.
Are you both flying back from the Phillippines together? If so, just tell the border agent what’s going on when you get to your agent, and tell your beloved to make sure that her border agent knows that she’s entering on a K1. While this is big and important to you, it’s boring everyday shit to them and they’ll send you to the right place. The right place for her is secondary inspection; it can’t hurt nothin’ to ask to go with her, but ISTR hearing of people sent ahead to wait on the other side of secondary inspection.
Employment: She almost certainly won’t be able to work until you marry, get the marriage certificate, file AOS + EAD + AP, and she gets the EAD. Expect this to take at least 3 months after marriage. While K1s are theoretically work authorized, it’s apparently nearly impossible to get enough documentation to convince an employer of legitimate authorization unless you enter at JFK, who will apply a “WORK AUTHORIZED UNTIL ____” stamp to the K1.
Useful hints: after you file AOS, she still has a lawful status. Apparently that status is “pending adjustment.”
The day she finally gets her 10-year green card is a good day. Unless, as biscotti’s did, it lists her nationality incorrectly.
*Do I remember this correctly? It’s 180 days to use the visa, and then 90 to marry, right?
